There should be someone at the table with the knowledge and authority to ensure that privacy principles consistent with GDPR, a new EU data privacy mandate, are in place. The effective date for GDPR compliance is May 25, 2018.A new European Union (EU) General Data Protection Regulation (GDPR), aimed at protecting the data and privacy of its data subjects has in-house legal teams and the entire C-suite scrambling to meet compliance. Any company that does business in the EU is subject to the mandate, which takes effect on May 25, 2018. The rules are sweeping, and the consequences of non-compliance are severe, with administrative fines reaching 20 million euros or up to 4 percent of a companys previous years annual revenue. Yes, this is real.While many U. S. companies are not fully prepared to meet this compliance deadline, its not too late. The best way forward is to draw up a roadmap. And if youre just coming up to speed on GDPR, you should consider your next steps very carefully.GDPR compliance should be led by a champion - the president or a corporate data privacy or compliance officer, or the chief information officer. Ultimately, you may need to appoint a data protection officer, if you dont already have one in your organization and you fit within certain specified criteria. Establishing a steering committee is another matter of urgency, as this will ensure buy-in from business owners, from the C-suite up to the board of directors.GDPR explainedThe new regulatory mandate regarding personal data applies to companies established in the EU, or companies offering goods or services to data subjects in the EU. There is no citizenship requirement for data subjects (employees or customers) it applies to anyone who is situated in an EU country when the data is collected, and a potentially broader scope for companies established in the EU.GDPR is organized in a way that allows companies to divide compliance into practical work streams. A best practice would be to assign each of those buckets to an individual responsible for compliance, working with both IT and key stakeholders or business owners.Crucial principles that may be novel to U.S. companies fall under the heading Data Protection by Design and by Default in Article 25. Today, companies that collect personal data typically look for ways to leverage personal data to monetize their relationship with a customer or upsell additional products. There needs to be someone at the table with the knowledge and authority to insist that those discussions incorporate privacy principles consistent with GDPR.The U.S. has an opt-out business culture - companies assume customers agree to personal data collection, and they must deliberately opt out to be exempted from that p ractice. In the EU, however, companies typically will not collect personal data without asking customers first. GDPR writes this into the law and is consistent with previous privacy regimes and a general pro privacy culture.Steps to take to right nowA critical, early priority is conducting a personal data inventory - the exercise of determining what personal data your company has, where it is and who touches it. Its a discovery exercise, which could take two days or more than three weeks, depending on the scale and complexity of the data.GDPR offers recommendations for compliance. For example, the mandate suggests encryption, pseudonymization or anonymization data protection strategies under Article 32, Security of Processing, but does not prescribe specific tools or approaches. With respect to notice, the statute is fairly specific. If you collect an individuals personal data, you have to tell that individual what youre collecting, why you collect it and how long you will retain i t, and you must promise that you will retain it only as long as necessary for that stated purpose.Companies just getting started should focus first on applications with the most privacy-sensitive personal data (especially health-related data) and prioritize their 10 to 20 most sensitive applications. In the meantime, work with key constituencies, including general counsel, privacy officer, the compliance team and the chief information security officer, to set up a game plan to handle the rest of your applications in order of sensitivity, with milestones, roles and responsibilities, achievable in a reasonable period of time.Potential roadblocksA novel GDPR requirement is the customers right to access data. In certain cases, it may be difficult to develop a process to deliver the requested data in a functional, portable format.Still more challenging will be compliance with the individuals right to be forgotten - to insist that data be deleted from company databases on request. The ri ght to be forgotten is specified, but it is not absolute. It can be overridden by competing concerns, such as the existence of a compliance obligation.Additional challenges arise immediately in the event of a data security breach, which, once known, is like waving a red cape in front of a bull. Believe it or not, youve always had a chain of command in one way or another, even if thats not what it was called. For a loose example, lets say you started work as a delivery person at a pizza joint if there was a problem, you would look to your immediate supervisor for help or direction, who would (if necessary) go to the manager, who would go to the boss or owner for resolution. Any changes to the job would likewise use the same route in reverse the b oss makes a decision that drivers must wear a company jacket when making deliveries s/he tells the manager, who tells the supervisor, who tells you (and, hopefully, gives you the necessary jacket). Even in the home and at school, there are various chains of command. The military just makes it more formal, in order to ensure that everyone understands their responsibilities and to whom they report. The Navys Top Officer The Army, Air Force and Marines all have a general as their top officer. But like other navies, the U.S. Navys top commissioned officer is called an admiral. The term comes from the Arabic phrase amir-al bahr, which translates as commander of the seas. The highest-ranking admiral in the U.S. Navy is a fleet admiral. The last time a fleet admiral was appointed, however, was World War II. And only once in history was the rank of Admiral of the Navy designated, to George Dewey by a special act of Congress in 1899. Since then, the four-star admiral has been the highes t achievable rank by a Navy officer. The Navy chief of operations, a four-star admiral, is its highest-ranking officer in the modern-day Navy, serving under the Secretary of the Navy. He or she also is a member of the Joint Chiefs of Staff. You know the type- nothing pleases them and they find fault in management’s every utterance, implicitly suggesting the people in charge are operating with a fatal deficiency of intelligence and common sense. There’s nothing new in the workplace that escapes this critic’s eyes, and they are comfortable sharing their caustic commentary with anyone below the management level. They seem to thrive on the negative work-talk and are like moths to light with anyone who will listen.   Effective managers work quickly to stop these characters before the damage to morale spreads and threatens the team’s working environment. And like every management situation, there are right and wrong approaches for dealing with difficult people. These tips will help you find the best approach to deal with chronic complainers.   Don’t Minimize the Potential Damage From Chronic Complainers These not-so-silent saboteurs operating mostly below the management levels of the organization are comparable to that slow drip from the leaky water pipe in the ceiling. For a while, the drops of water don’t do much damage, but over time, they are capable of creating a stain or even bringing the ceiling down.   The chronic complainer infects the working environment by spreading negativity and creating doubt in the minds of team members. For managers and team members striving to implement a new program or policy, this subtle but aggressive behavior gets in the way of driving positive change.   Avoid These Two Approaches to Dealing With the Chronic Complainers Two methods commonly applied to dealing with chronic complainers include: Attempting to win them over by selling them in advance on your ideas.Ignoring the issue and relegating the steady cadence of complaints to background noise.   Both of these approaches are less than ideal. I’ve lost count of the number of managers I’ve heard utter a phrase that sounds something like: That’s just (name). He’s harmless. He doesn’t like anything new, but he always comes around to supporting the program.   The manager who either ignores or rationalizes the behaviors of this employee is ignoring the cumulative damage from the steady drip of complaints. Instead of rationalizing or excusing the behavior, she should focus on eliminating it. Unfortunately, in attempting to justify the behavior, she’s damaging her credibility with her broader team.   The manager who goes out of his way to neutralize the complainer by making a direct appeal for support is only playing into this character’s game. In the mind of the complainer, the manager has legitimized him/her by seeking approval. More often than not, this exacerbates the problem, with the complainer now able to brag to others that his/her approval was actively requested and withheld. Instead of ignoring the complaining behavior or attempting to assuage the individual by appealing to his/her ego, active managers use a direct approach by coaching first, counseling second and requiring accountability for behavior each step of the way.   7 Tips for Dealing With Chronic Complainers First, set clear expectations for workplace performance and engagement. Often, chronic complainers emerge in environments where standards of performance and behavior are poorly defined and where accountability for actions  is not enforced. If your firm has clearly articulated values, make those an integral part of your team’s or department’s environment. If the values are not present, work with team members to establish the values they believe are essential for a healthy working environment.  Teach team members to make their concerns about policies, programs or activities visible to the broader group. Hold people accountable for proposing and following thru on actions to remedy the issues. Establish that it is culturally inappropriate to complain behind the scenes. Engage and observe. Effective managers focus on both engaging with their team members and observing behaviors in a variety of settings. You cannot coach or offer constructive or positive feedback without the context that comes from observing and engaging. Chronic complainers survive and thrive in environments where the manager tends to operate at a distance and struggle to gain traction where the manager is closely involved with team members.  Continually solicit input from your team members on the working environment. Chronic complainers are crafty at remaining below the surface and out of earshot of their managers. However, a manager, who is always engaging with all of their team members to understand how things are going, is able to focus on those individuals and behaviors that detract from morale and performance. Use straightforward approaches and conversations as well as formal surveys and 360-degree reviews to build a body of evidence on the group and individual performance.   Offer timely, clear feedback and coaching to chronic complainers. Once you’ve gained context for the complaints of a team member, it is critical to engage quickly and constructively with the individual. I encourage managers to focus initially on coaching the person by providing insight into the destructive nature of constant complaining in the working environment. Tie the behavior to the impact it has on performance and morale. Indicate the damage to the complaining individual’s career, and showcase positive approaches to offering critical input on programs, policies, or activities in the workplace.   Recognize when it is time to escalate. If behaviors do not change, it is time to move from coaching to counseling. ?Coaching is designed to elicit positive change in behaviors by offering guidance, encouragement and specific, actionable feedback. Counseling offers clear feedback that the behaviors are unacceptable and identifies the implications of failing to change the behavior. Work with your human resources manager to structure a counseling session. Make certain to provide documentation on all of the prior feedback and coaching. Gain support for presenting the employee with a performance improvement program that has implications if performance fails to improve. And then follow-up!   Don’t hesitate to get the complainers out. Assuming you are working closely with your human resources team and have followed the steps above, you owe it to your team, your firm, and yourself to get toxic people out of the workplace. While chronic complainers seem harmless on the surface, remember the example of the leaky water pipe!   The Bottom Line Creating an environment where motivated employees are encouraged and given the freedom to do their best work is job one for every manager. It starts with hiring the right people and continues with creating a culture of accountability for positive behaviors, including identifying and remedying problems. There’s no room for chronic complainers in a healthy workplace.

Here’s a proven formula for success when you are ready to ask for a raise. 1. Know your market value Do you know how much you’re worth? If not, you need to find out. Accounting and finance professionals are no strangers to analyzing data. Apply the same rigor to your salary negotiation tactics. If you go in blind when you ask for a raise, you risk asking for too much or too little - neither of which is ideal. It’s important to know what professionals with similar skills as you earn in your local area, because compensation levels can vary drastically across the country. In surveys and research studies, managers who struggle with delivering constructive feedback are concerned that they will not be liked or, they fear creating an incident by offering criticism.   By following and practicing the suggestions outlined in this article, the manager can take the fear out of delivering negative feedback and turn the conversation into a constructive event.   10 Tips to Help You Deliver Negative Feedback Get your emotions under control. You dont want to critique someone elses actions when you are angry or upset. If tempers are hot, take the time to let things cool down. While effective, constructive feedback is delivered as close to the observed incident as possible, if the situation is heated, it is fine to schedule a meeting for the next day.Never deliver negative feedback in front of team members. Find a private place. Conduct the meeting in your office or schedule a conference room for your feedback discussion. Focus on the observed behavior, not the person. Remember, the purpose of constructive feedback is to eliminate behaviors that detract from high performance. If the individual perceives he or she is being attacked personally, they will quickly turn defensive, and the opportunity for a meaningful discussion will be lost.  Be specific. Effective feedback is specific. Suggesting, John, you sure goofed that up, might be true, but it does not tell John what he did wrong. The same goes for telling Mary that she is late to work too often. Instead, describe the very specific behavior and identify the business implications of the behavior. For example: Mary, when you are late for your shift, it requires us to hold someone over from the earlier shift. This requires us to pay overtime; it inconveniences your colleague, and it may reduce quality if they do not understand your specific job. Do you understand?   Be timely. If you have ever received a long list of negative feedback comments on an annual performance review, you understand how worthless this input is long after the fact. Feedback of all types  should be given as soon as possible after the event.Remain calm. Regardless of how upset you are, it never pays to lose control of your emotions. As referenced above, if you need time to gather your emotions, delay the discussion a few hours or at most a day. Remind yourself that the intent of feedback is to promote improvement and approach the discussion with this positive attitude.   Reaffirm your faith in the person. It reinforces step three, but here you tell them that you still have faith in them as a person and in their abilities; its just their performance you want them to change. Say something like youre a good customer service rep, so Im sure you see the need to be more patient with customers.Stop talking and invite the other party to engage. After you have told the person what specific, recent actions were inappropriate, and why, stop talking. Give the other person a chance to respond to your statements and ask clarifying questions.   Define and agree on a mutually acceptable action plan. Agree on what future performance is appropriate for the employee. If there are specific things the employee needs to start doing or needs to stop doing, be sure they are clearly identified.
